Enhanced Games Files $800 Million Antitrust Lawsuit Against World Aquatics, the World Anti- Doping Agency and USA Swimming

New York, NY – August 27, 2025 – Enhanced Games filed a lawsuit today in the United States District Court for the Southern District of New York against World Aquatics, USA Swimming and World Anti-Doping Agency for violations of Sections 1 and 2 of the Sherman Act. The lawsuit responds to defendants’ blatantly predatory and illegal campaign to force anyone involved in the sport, including athletes, support staff and officials, to boycott the Enhanced Games and to stop the Enhanced Games from entering the market for international elite swimming.
The defendants have dominated the world of international aquatic sports for decades, and their efforts to crush Enhanced are just the latest in their campaign to kill any potential competitor.
The lawsuit seeks at least $200M in actual damages, increasing to at least $800M after statutory trebling, punitive damages awards, and the recovery of attorneys’ fees. The Enhanced Games will also seek injunctive relief to stop the defendants’ illegal campaign.
On June 3, 2025, World Aquatics adopted a new By-law 10, that threatens to ban from all of its games, including the Olympics, athletes and non-athletes (including coaches, trainers, doctors, physiotherapists and others) who participate in, actively support or even endorse any sporting event or competition that embraces scientific enhancements, whether or not they use any performance enhancing substances or commit any anti-doping violation under the WADA Code. The transparent purpose of the by-law is to deny Enhanced access to the elite swimmers and other personnel it needs to hold successful Games in May 2026, scheduled in Las Vegas, and to emerge from those Games as a competitive threat to World Aquatics.
“World Aquatics’ By-law 10 is a thinly veiled attempt to strong-arm the swimming community into boycotting the Enhanced Games. They’re holding elite swimmers and support staff hostage, threatening lifetime bans from Olympic events – all without a single anti-doping violation. To claim this is about protecting the ‘integrity’ or ‘health and safety’ of athletes is utter hypocrisy,” said Dr. Aron D’Souza, President & Founder of Enhanced Games. “The widespread, unchecked use of performance-enhancing substances in their own events is an open secret, and it’s well-documented that they tolerate state-sponsored doping when it serves their financial interests. The audacity of World Aquatics to invoke ‘integrity’ while under investigation by Congress and the U.S. Department of Justice for their complicity in the 2021 Chinese swim team doping cover-up is truly astounding. This isn’t about fair play; it’s about a decades-old monopoly desperately trying to crush competition and treat athletes like indentured servants rather than the dedicated professionals they are.”
