Terms and Conditions

The following Terms and Conditions govern participation in and use of Enhanced's Refer-a-Friend Program and supplement Enhanced's Terms of Service. Information processed in connection with the Refer-a-Friend Program is subject to Enhanced's Privacy Policy and Enhanced's Consumer Health Data Policy. The Refer-a-Friend Program is administered through Friendbuy's platform, and information submitted in connection with the Refer-a-Friend Program may be processed by Friendbuy on Enhanced's behalf in accordance with Friendbuy's applicable privacy practices.

1. Definitions

As used in these Terms and Conditions, the following capitalized terms have the meanings set forth below:

"Personal Referral Link" means the unique referral link generated by the Refer-a-Friend Program and assigned to a specific Referrer for purposes of referring eligible new customers.

"Qualified Referral" means a purchase made exclusively at www.enhanced.com or care.enhanced.com (collectively, the "Website") (and not through any other channel, third-party retailer, or platform) by a Referred Customer who arrives at the Website by clicking a Personal Referral Link. Only one Qualified Referral is counted per Referred Customer; additional or repeat purchases by the same Referred Customer do not constitute additional Qualified Referrals.

"Refer-a-Friend Program" or "Program" means the referral rewards program offered by Enhanced and administered through Friendbuy's platform, as described in these Terms.

"Referral Reward" or "Reward" means the promotional discount or other incentive issued by Enhanced to a Referrer and/or Referred Customer upon the completion of a Qualified Referral, as described in Section 4 (Referral Rewards) below.

"Referred Customer" means an individual who: (a) has not previously made a purchase on the Website; (b) arrives at the Website by clicking a Referrer's Personal Referral Link; and (c) completes a purchase. The Referred Customer and the Referrer cannot be the same person.

"Referrer" means an individual who participates in the Refer-a-Friend Program by sharing their Personal Referral Link with others for the purpose of earning Referral Rewards.

"Terms" means these Refer-a-Friend Program Terms and Conditions, as amended from time to time.

2. Program Eligibility

The Refer-a-Friend Program is open to individual persons that are legal residents of the United States and eighteen (18) years or older. Entities, organizations, or groups of any kind are not eligible to participate in the Refer-a-Friend Program. Enhanced's Refer-a-Friend Program cannot be used by businesses for affiliate lead generation as determined in Enhanced's sole discretion. Any attempt to circumvent these eligibility requirements or otherwise manipulate eligibility for the Program is prohibited. See Section 6 (Fraud and Program Abuse) below for a description of specific prohibited conduct and applicable consequences.

3. How the Program Works

For a Referrer to earn Referral Rewards, the Referred Customer must be a new customer and make a purchase. A "new customer" is defined as a person who has not previously made a purchase on the Website. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). In the event a Referred Customer receives a Personal Referral Link from multiple Referrers, only the Referrer whose Personal Referral Link is actually used to complete the purchase is eligible to receive the Referral Reward.

4. Referral Rewards

Referral Rewards are currently issued as $25 off the Referrer's next order for each Qualified Referral, and 25% off the Referred Customer's first order when the Referred Customer completes a purchase on the Website using a Personal Referral Link. Enhanced reserves the right to modify the Reward amount, structure, or form at any time in its sole discretion; the then-current Reward amount will be reflected on the Refer-a-Friend Program page on the Website. Enhanced may also modify the eligibility requirements, qualifying purchase threshold, or other Program requirements at any time in its sole discretion.

As a Referrer, you are responsible for any and all tax liability resulting from Referral Rewards. Referral Rewards are issued solely as promotional discounts toward eligible purchases. Rewards have no cash value except where required by law, are personal to the recipient, are non-transferable, may not be sold, traded, exchanged, or redeemed for cash, and may not be combined with other offers or discounts unless expressly permitted by Enhanced. Rewards shall expire six (6) months after issuance, are subject to the continued operation of the Refer-a-Friend Program and, where applicable, availability of supply, and are not earned at the time of purchase.

A Reward will only be issued after the associated order has been completed, paid in full, and verified by Enhanced, and after a thirty (30) day holding period following the Qualified Referral purchase has elapsed, during which the order remains subject to return, cancellation, chargeback, fraud review, or refund. If the associated order is returned, cancelled, refunded, or reversed during this holding period, no Reward will be issued.

5. Restrictions

By participating in the Enhanced Refer-a-Friend Program, Referrers agree and acknowledge that the following restrictions apply to their participation and sharing of Personal Referral Links. Enhanced reserves the right to deactivate any Personal Referral Links shared in violation of these Terms.

• Disclosures and Consent: Referrers are responsible for complying with all applicable advertising, endorsement, and consumer protection laws when sharing Personal Referral Links, including the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255). Each time a Referrer shares a Personal Referral Link, including on social media, in email, via text, or through any other channel, the Referrer must make a clear and conspicuous disclosure of their material connection to Enhanced, including the fact that they will receive a Reward if a Qualified Referral occurs. Such disclosure must be placed where it is easily noticeable and understandable to the audience, and may not be buried in a caption, hidden behind a link, or obscured by other content. Referrer must also obtain the recipient's consent before sharing a Personal Referral Link with them directly.

• Offensive Conduct: Referrer shall not share a Personal Referral Link in connection with any content or conduct that is offensive or inappropriate, including pornography, obscenity, indecent language, or content that incites hate, is demeaning, disparages the Enhanced brand, or endorses discrimination in any form.

• Intellectual Property: Referrer shall not use Enhanced's trademarks, logos, trade names, service marks, or other intellectual property in any manner in connection with the Refer-a-Friend Program, except as expressly authorized by Enhanced. Any unauthorized use of Enhanced's intellectual property may result in immediate termination of Referrer's participation in the Refer-a-Friend Program, forfeiture of any pending or unpaid Referral Rewards, and pursuit of all available legal and equitable remedies.

6. Fraud and Program Abuse

Enhanced has a zero-tolerance policy for fraud and abuse of the Refer-a-Friend Program. The following conduct is strictly prohibited:

1. self-referrals, including referring oneself using a different email address, account, or identity;

2. creating or using fake, duplicate, or unauthorized accounts to generate Referral Rewards;

3. using multiple identities, devices, or IP addresses to circumvent program limits or eligibility requirements;

4. payment fraud, including the use of fraudulent payment methods, chargebacks, or returns to retain Rewards associated with a qualifying purchase;

5. coupon stacking or combining Refer-a-Friend Rewards with other promotions or offers in a manner not expressly permitted by Enhanced; and

6. any other conduct intended to manipulate, exploit, or abuse the Refer-a-Friend Program or its reward structure.

If Enhanced determines or reasonably suspects that a participant has engaged in any of the foregoing conduct, Enhanced reserves the right to cancel any associated Rewards, immediately suspend or terminate the participant's access to the Refer-a-Friend Program, and take any additional action available under these Terms, including account closure. Enhanced's determination as to whether any conduct violates these Terms or constitutes fraud, abuse, or misuse of the Refer-a-Friend Program shall be final and binding.

7. Verification of Referrals

7.1 Verification

All referral transactions and associated Rewards are subject to review and verification by Enhanced. Enhanced reserves the right to delay, investigate, or audit any referral activity for any reason. Completion of stated qualifying criteria does not guarantee the issuance of a Reward.

7.2 Right to Withhold or Revoke Rewards

Enhanced reserves the right, in its sole and absolute discretion, to withhold, deny, cancel, or revoke any Reward associated with conduct described in Section 6 (Fraud and Program Abuse) above, any other violation of these Terms or Enhanced's Terms of Service, or any referral activity that Enhanced determines is invalid. If a Reward has already been credited or applied to a participant's account and Enhanced subsequently determines it was obtained in violation of these Terms, Enhanced reserves the right to reverse the transaction or debit the equivalent value from the participant's account.

8. Compliance With Law

Referrers must comply with all applicable laws, rules, and regulations, including those governing the transmission of email or other electronic communications and the sharing of Personal Referral Links. Any emails or other communications generated in connection with the Enhanced Refer-a-Friend Program must be created and shared by the Referrer in a personal manner. Referrer may not send bulk email communications, nor may Referrer use any script, program, bot, automatic dialer, artificial intelligence, or other automated system to share a Personal Referral Link with a mass audience or the general public. Any sharing of a Personal Referral Link in a manner that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of the account and exclusion from Enhanced's Refer-a-Friend Program.

9. Right to Close Accounts

Enhanced reserves the right, in its sole discretion, to suspend or terminate the account(s) of any Referrer or Referred Customer if Enhanced reasonably believes that the Referrer or Referred Customer has violated these Terms, Enhanced's Terms of Service, or any applicable law, engaged in fraud, abuse, or other conduct prohibited by these Terms, or otherwise participated in the Refer-a-Friend Program in a manner inconsistent with its intended purpose. Enhanced may also withhold, deny, cancel, revoke, or recover any Referral Rewards associated with such conduct and, where appropriate, require repayment of the value of any improperly obtained or redeemed Referral Rewards.

10. Right to Cancel Program or Change Terms

Enhanced reserves the right to cancel the Refer-a-Friend Program or to change these Terms at any time in its sole discretion, with or without notice and for any reason. In the event Enhanced modifies these Terms, the updated Terms will be posted on its Website and shall become effective upon posting. Continued participation in the Refer-a-Friend Program following any modifications constitutes the Referrer's consent to such modifications. Any unclaimed Referral Rewards will be forfeited at that time. Termination of the Refer-a-Friend Program shall not affect Enhanced's right to investigate prior referral activity or recover improperly issued Referral Rewards.

11. Incorporation of Terms of Service

Except as expressly provided in these Terms, the following provisions of Enhanced's Terms of Service are incorporated into these Terms by reference and govern participation in the Refer-a-Friend Program: limitation of liability, disclaimer of warranties, dispute resolution (including any arbitration agreement and class action waiver), governing law and venue, indemnification, and any other general legal provisions of Enhanced's Terms of Service that are not specific to product purchases or subscriptions. In the event of a conflict between these Terms and Enhanced's Terms of Service with respect to the Refer-a-Friend Program, these Terms shall control.

12. Assignment

Referrer may not assign any of its rights or obligations under these Terms to any third party without the express written consent of Enhanced, and any attempts to assign such rights or obligations shall be null and void.

13. Severability and Waiver

If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. Enhanced's failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

14. Interpretation

Unless the context otherwise requires, defined terms used in the singular include the plural, and defined terms used in the plural include the singular. The words "include," "includes," and "including" mean "including without limitation."
