These Waitlist Deposit Terms (“Terms”) are between you and Enhanced Ltd (“Enhanced,” “we,” or “us”). These Term governs your deposit and reservation for priority access to the Enhanced Health Program (the “Program”).

1. Reservation

By entering into these Terms and paying your deposit, you reserve a spot for priority access to the Program. However, these Terms do not constitute an agreement to sell you access to the Program or guarantee functionality, services, pricing, or an estimated launch date. Functionality, services, pricing, and launch date of the Program are subject to change. 

2. Refundable Deposit

To reserve your spot for priority access to the Program, you agree to pay a fully refundable US $99 deposit. This deposit secures your position on the waitlist and will be applied toward your first purchase if you are eligible for and proceed with the Program. 

You may request a full refund at any time before six (6) months after the Program launches. If you do not complete your eligibility form before six (6) months after the Program launches or Enhanced otherwise chooses in its sole discretion to initiate a refund, your deposit will be automatically refunded. Your refund rights will expire once any portion of your deposit is applied toward payment for any part of the Program. After requesting a refund or when your refund is otherwise initiated by Enhanced, your priority access to the Program will be canceled.

We will hold your deposit for you in an account that is exclusively used for the purpose of holding customer deposits, segregated from our own funds, unless and until you instruct us to apply your deposit towards your first purchase or we initiate a refund to you. 

To request a refund, forward your confirmation email (or provide order details) to support@enhanced.com with the subject line “Refund request.” Refunds will be initiated within two business days and typically returned to the original payment method within five to ten business days. Refunds will be credited to the original form of payment that was used when the deposit was made.

3. Payment Method and Chargebacks

You authorize us to charge all amounts to the payment method you provide to us for the deposit as stated on the Website when you agree to reserve a position on the waitlist. All credit and debit card holders are subject to validation checks and authorization. If we believe that the payment card used to pay a deposit is being used fraudulently or otherwise not valid in our sole discretion, we may (a) report this information to the relevant authorities, (b) refuse to add you to the waitlist or remove you from the waitlist, and (c) terminate these Terms as to you.  If your payment card issuer refuses to authorize payment, we will be unable to add you to the waitlist and we will not be responsible for your not being added to the waitlist.  We will not be informed of the reason for payment refusal and therefore, we are unable to inform you of the reason that your payment card issuer has refused payment. We are not responsible for any payment card or bank charges issued by your payment card issuer as a result of processing your deposit. Enhanced uses a third party for payment processing.

Before filing any chargeback request against Enhanced, you must notify us first and provide us a reasonable opportunity to dispute or otherwise resolve the matter. You acknowledge and understand your filing of a chargeback may result in the immediate termination of these Terms and your removal from the waitlist without prior intervention of a court or arbitral tribunal.

4. Notification of Launch

You will be notified via email when the Program launches. That email will include a link to complete an eligibility form. If you are found ineligible or you do not complete your eligibility form within 6 months after the Program launches, your deposit will be automatically refunded even if it is outside the 6-month window.

5. Non-Transferability

This waitlist reservation is personal to you and may not be assigned or transferred to another person without our prior written approval.

6. Privacy

By reserving your spot for priority access to the Program, you agree that we may collect and use your personal data in accordance with the Privacy Policy.  We may use your personal data for reservation and Program-related communications and purposes. You will also be enrolled to receive our e-mail newsletter, from which you may unsubscribe at any time. Please review our Privacy Policy for more information.

7. Incorporation by Reference

By entering into these Terms, you acknowledge and agree to be bound by our Terms of Service available at [link] (“Terms of Service”) and to participate in the waitlist for priority access to the Program. The Terms of Service are incorporated herein by reference. If there is any discrepancy or conflict between these Terms and the Terms of Service, these Terms will apply. Further, if there is any discrepancy or conflict with any website or email language related to the subject matter herein, these Terms shall apply and not the website or email language.

8. Limitation of Liability

You agree to the disclaimers and limitations set forth in the Terms of Service. To the fullest extent permitted by law, our liability under these Terms is limited to the return of your deposit amount. We make no guarantees regarding Program eligibility, availability, or results.

7. Arbitration

The arbitration terms in the Terms of Service shall apply to these Terms.

PROVISIONS SPECIFIC TO THOSE ORDINARILY RESIDENT IN AN EEA MEMBER STATE OR THE UK

1. Right to Withdraw or Cancel a Distance Contract 

Notwithstanding your right to receive a refund of a deposit as outlined in section 2 (Refundable Deposit) above, you have the right to withdraw from or cancel these Terms within 14 days of paying a deposit without the need for you to give any reason, after which the withdrawal or cancellation period will expire. To exercise this right, you must inform us via email at legal@enhanced.com of your decision to withdraw from or cancel these Terms by a clear statement. To meet the 14-day deadline, it is sufficient for you to send your communication concerning your exercise of this right before the 14-day period has expired. If you cancel these Terms, we will reimburse your deposit in full without undue delay and not later than 14 days after the day of receipt of your decision to withdraw from or cancel these Terms. We will refund your deposit using the same payment method used by you when paying your deposit, unless you have expressly agreed otherwise. In any event, we will not charge you any fees as a result of the refund.  We are not responsible for any payment card or bank charges issued by your payment card issuer as a result of refunding your deposit.

2. Governing Law and Venue 

Sections 8 (Arbitration) above does not apply to you.  Nothing in these Terms exclude the application of mandatory consumer protection law.  Any right you have under such mandatory laws to settle disputes under these Terms under local law and in local courts is not excluded.  The Parties hereby agree that the United Nations Convention on Contracts for the International Sale of Goods does not govern these Terms.
